- ItemOpen AccessConstitutional negotiations in Canada and South Africa : a comparative analysis(1999) McDonald, Kory; Kuye, Jerry OThe achievement of a negotiated settlement in South Africa and the negotiation of a new constitution in the mid-1990's piqued the interest of students of conflict resolution and constitutional politics throughout the world. Similarly, numerous failed attempts to achieve a package of amendments to Canada's constitution have attracted the attention of scholars seeking to explain why the attempts have failed and where Canada's future lies. The purpose of this study was to compare the negotiations that took place in both South Africa and Canada to explain why South Africa succeeded in negotiating a new Constitution, whereas Canada has been unable to amend its Constitution despite repeated attempts. The study applied the social-psychological model of negotiation and bargaining to both cases and isolated variables in four areas to allow for a comparative analysis. The four dimensions of negotiation and bargaining that were explored were: (1) structural factors, (2) behavioural dispositions, (3) interdependence factors, and (4) social influence strategies. The data used for the comparative analysis was collected through a review of selected literature produced on the South African and Canadian constitutional negotiations.
- ItemOpen AccessCritical perspectives on justice and affirmative action : the case for transformation of South Africa's public service(1999) Mashile, Selby H; Kuye, Jerry OSouth Africa has embarked upon a major transformation process and this implies fundamental alterations in the social structure. Of course, the transformation process in South Africa cannot be described as a mechanical change intended to introduce inconsequential cosmetic changes because it entails fundamental alterations of the interaction between the state and its citizens. Beyond this, the transformation process in South Africa is not confined to the alteration of the various institutions of the state, it implies as well, fundamental alterations in culture, the manner in which different groups perceive and interact with each other and a complete eradication of supremacy mentality of one racial group over others. The magnitude with which these changes take place is bound to produce tensions and social problems in any country engaged in the democratisation agenda of its society. However, the moral precision of these social changes needs to be questioned and investigated on a continuous basis. It would be naive and dangerous for social engineers to assume that all changes brought by the transformation process are morally unobjectionable. This study explores, therefore, South Africa's past discrimination and investigates the arguments for and against affirmative action within the libertarian and contractarian frameworks. Through literature survey, the study investigates whether the application of these philosophical models can be appropriate for the South African situation. Moreover, although this study has established that both the libertarian and contractarian models offer a room for the justification of affirmative action in a situation such as South Africa's it is concluded that the scope within which these models justify affirmative action is too narrow to undo the harm created by South Africa's past injustices. Beyond this, the study explores a link between the transformation process and the restructuring of the Public Service and argues that the two should not be viewed in isolation from each other given their interdependent relationship. Equally important, the need and rationale behind instituting new management styles in the Public Service and the possible impact this would have on the overall transformation project is investigated. The entrance of South Africa into the global economic market entails serious implications on the formulation and implementation of its local programmes and other transformation initiatives and thus, the study explores this area to establish South Africa's response to global demands and expectations. Finally, it is recommended in this study that South Africa should continue with the transformation process and application of affirmative action not only because of its history but largely because of its moral correctness.
- ItemOpen AccessEconomic structural adjustment programmes in the Southern African development community : an analysis of impact and policy considerations with special reference to Zambia and Zimbabwe(1999) Gumede, Nyawo Basirio Simbi; Kuye, Jerry OThis study is primarily aimed at examining the impact of World Bank / IMF, structural adjustment programmes in the SADC region. However, the main focus of the study was on Zimbabwe and Zambia. These World Bank / IMF-influenced perestroikas, are believed to be viable panacea, for the state of economic malaise prevalent in the SADC region. In undertaking this research, various methods were utilised to acquire data. A case study approach was used. However, the main method of data collection which was heavily relied upon was document study. The collected data was analysed and presented in both graphical and tabular form. This study, inter alia, established that the implementation of IMF / WB structural adjustment programmes in the SADC region has precipitated a plethora of insurmountable socio-economic problems for the citizenry of both Zimbabwe and Zambia. Furthermore, the research has revealed that IMF / WB influenced structural adjustment programmes have culminated in large-scale unemployment, retrenchments, an acute decline in educational and health standards, ever-skyrocketing food prices, rents, taxes, mass exodus of qualified human resources to greener pastures, big debts, inflation and labour strikes in Zimbabwe and Zambia.

The historical imbalances created by decades of Apartheid policies demanded employment of specific programmes in order to correct the situation. The period witnessed major transformation that is mainly intended to accommodate the previously marginalised communities; blacks, women and disabled people. These changes brought about the birth of affirmative action. Therefore, this study’s intention is to seek to examine "How successful has UCT been in achieving employment equity and why?" The main aim of this study is not attacking UCT’s achievement of Employment Equity, but to establish UCT’s course of action as well as inaction in achieving Employment Equity and the promotion of Affirmative Action. Comparative study analysis is used as a tool to capture information and data around the progress made in achieving Employment Equity and the promotion of Affirmative Action at UCT.
- ItemOpen Access“Implications of South Africa’s new language policy with special references to the implementation of African languages as media of instruction”(1999) Mmusi, Eboleleng Jacobus; Kuye, Jerry OThis study has explored the New Language Policy of South Africa, with special reference to African languages as possible media of instruction, at pre-tertiary level of education. The most critical and relevant linguistic aspects examined here, takes into account the issue of multilingualism in education or multilingual education (particularly the issues that still handicaps it), the development of African languages and linguistic rights. The study provides a brief overview with regard to individual and collective rights in South Africa. In sum, the South African government’s attempt to implement the New Language Policy, in part, has been carefully examined. The study has also investigated the relationship between the New Language policy and the people it directly affects. In this respect, much attention has been paid to the attitudes of teachers and students of the African community, that is, African-language speakers, toward the New Language policy. However, the legitimacy of the New Language policy amongst the Afrikaans-speaking populace is not explored in this study. It is anticipated that further research will he conducted in this respect. This study has further demonstrated how the government can be entrapped through the designing of its public policies. Sometimes governments fail to implement the policies they have formulated and announced to the public. The New Language policy of South Africa is no exception. This study indicates that although the New Language policy is politically correct, it is practically unworkable, complex, problematic and controversial with regard to African languages as media of instruction. Some recommendations are provided to shed other alternatives with regard to the successful implementation of the New Language policy. The study indicates that the South African Government should minimise its eleven media of instruction. Whilst one language (English) should serve as a medium of instruction in predominantly African or Black public schools, other languages (African languages) should be taught as subjects in the school curriculum.
- ItemOpen AccessPolicy issues and regional integration: a case study of Nigeria'a policy in the economic community of West African States (ECOWAS) - 1979-1997(1999) Bah, Alhaji M S; Kuye, Jerry OIn West Africa, where most countries attained independence in 1960 or around that time, Economic co-operation and integration have been pursued at different levels with varying degree of successes. This study addresses Nigeria 's policy in the Economic Community of West African States (ECOWAS) between 1979-1997. It is an investigation of the forces that have been driving the integration efforts in West Africa. The study focuses on the period between 1979-1997. The analysis proceeds through three phases: Firstly the Alhaji Shehu Shagari Era 1979-1983; secondly, the General Muhammadu Buhari era 1983-1984; finally the General Ibrahim Babangida/Ernest Shonekan/General Sani Abacha eras 1984-1998. The policy posture of Nigeria as a regional power-broker is the focal point of analysis in relation to specific Protocols of the ECOWAS Treaty. Three policy courses pursued by Nigeria during this period have been the subject of examination in this study: the expulsion of illegal immigrants most of whom were citizens of ECOWAS member states in 1983 and 1985, the land border closure of 1984-1985, and Nigeria 's role in ECOMOG. These policies are analysed in tandem with the Protocol on the free movement of goods; persons and services, the 1979 Non-Aggression Pact, the 1981 Mutual Assistance Protocol and the Protocol dealing with landlocked and Island member states. Other sub- regional forces like the linguistic barriers between the Anglophone, Francophone and Lusophone speaking states, the involvement of external powers like France, Britain and the United States of America and the regional rivalry between Cote d 'lvoire, Senegal, Ghana, Burkina Faso and Nigeria are also interrogated. The study concludes that regional integration is the most viable alternative for the socio-economic development and political stability of countries in the subregion. However, because of the disparity in the level of economic development, the issue of free movement of persons should be handled with high political tact in order to avoid a repetition of the 1983 and 1985 Nigerian expulsions. Such moves may not be a contravention of the Protocol in question but will dampen the spirit of 'oneness' that is a sine qua non for the success of the Community. Moreover the implementation of such a sensitive Protocol as the 1979 Non-Aggression Pact and the 1981 Mutual Defence Agreement needs a clear mandate to reduce the controversy that arises over the interpretation of such Protocols. This will reduce the regional tensions and acrimony as is manifested over Nigeria 's pivotal role in ECOMOG. Finally, the study concludes that Nigeria has a very significant role to play in ECOWAS. The realisation of the dreams of the founders of the Community is highly dependent on a consistent policy course by Nigeria in the affairs of ECOWAS.

This study explores the field i l l terms of assessing the utility of contemporary policy techniques ill the intematiollal context and the implications thereof for environmental policy-making in South Africa. More recently, the politics of envirollmental policymaking has emerged as a major issue 011 both the agendas of the developed and developing nations. As underscored by the seminal Rio Earth Summit of 1992 the e11viro11melil is probably the most pressing challenge facing tile globe in the new millennium. Addressing and prioritising these policy issues may require radical policy shifts. However, this study shows that policy conditionalities prevailing i l l the more industrialised nations have been developed in a different context and may therefore be irrelevant and of limited utility to less developed nations, forcing the latter to subvert the conventional policy cycle. Specifically, this study has explored the context of environmental policy-making in South Africa and extrapolated essential policy proci!dures and elements for its environmental policy-making along the policy-making continuum. In addition, an over-arching framework of sustainable development must support environmental policy development in South Africa. International experience regarding the emerging sustainability paradigm and its relevance for South African policy development is paramount if it is not to lag global environmental policy innovations and developments. Sustainability should emerge as a key organising principle for debate around policy content and structure with the imperative of responding to local policy conditionalities and priorities. As long as South Africa and many developing nations employ industrialised policy techniques, its policy processes and principles will lag effective and context specific policy research and development.
